There are three grounds for divorce in Ontario: separation, adultery, and cruelty.


To file for divorce in Ontario, you must meet one of three grounds as outlined in Canadian law:

  • Separation: You and your spouse must live separate and apart for at least one year with the intention to end the marriage.

  • Adultery: Proof of one spouse’s infidelity.

  • Cruelty: Evidence of physical or mental cruelty, making continued cohabitation intolerable.
