SMS Terms and Conditions

Introduction

These SMS Terms and Conditions govern your use of text message services provided by Divorce The Smart Way (“DTSW,” “we,” “us,” or “our”). By providing your mobile number and opting in to our SMS program, you (“you,” “your,” or “Client”) accept and agree to be bound by these terms, which supplement our general Terms and Conditions.

1. Program Overview and Consent

By enrolling in our SMS program, you authorize DTSW to send you text messages, which may include:

  • Appointment reminders and confirmations
  • Service updates and notifications
  • Account information
  • Promotional offers and announcements
  • Other relevant communications

Message frequency varies based on your activity and preferences. You are not required to consent to SMS communications as a condition of purchasing any services from DTSW.

2. How to Opt Out or Get Help

  • To unsubscribe: Reply STOP to any message from us. You will receive one final confirmation message.

3. Message and Data Rates

While DTSW does not charge for SMS messages, standard message and data rates from your wireless carrier may apply. Contact your mobile service provider for details about your plan and applicable charges.

4. Your Responsibilities

  • Update us immediately if you change or discontinue your mobile number
  • Refrain from any unauthorized or fraudulent use of the SMS service
  • Ensure your mobile device is capable of receiving text messages

5. Privacy and Data Protection

6. Service Availability and Limitations

Our SMS services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee:

  • Delivery, accuracy, or timeliness of messages
  • Uninterrupted or error-free service
  • Freedom from viruses or other harmful components

Message delivery may be delayed or fail due to factors beyond our control, including carrier network issues, device limitations, or technical outages.

7. Limitation of Liability

To the fullest extent permitted by law, DTSW shall not be liable for:

  • Delayed, failed, or misdirected messages
  • Any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use our SMS services
  • Lost profits, data loss, or business interruption

This limitation applies even if DTSW has been advised of the possibility of such damages.

8. Modifications and Termination

We reserve the right to modify, suspend, or discontinue our SMS program or these terms at any time, with or without notice. Material changes will be posted on this page with an updated effective date. Your continued participation in the SMS program after changes take effect constitutes acceptance of the revised terms.
